I'm an Indian, I have been working in Germany in Since January 2014, in a limited period(2 years) contract for an organization, which expires in 5th of January 2016. Now I have got a new opportunity for an permanent employment, In which I am supposed to join by December 2015. I interested in switching to the new company. In my contract it is mentioned that in case of voluntary resignation, I have to return back to India immediately and serve for three months in India as a notice. The above mentioned statement is only available in ENGLISH version of my contract, but there no such statement in the German version. What are all the legal consequences I might face while switching before completing two years of employment, How should I prepare myself legally. Kindly advice.
