My wife is employed in UK. I'm employed in Germany. Does law support us to transfer some maternity leave from my wife to me, even if my company is not willing to do it?

Here in Germany both father and mother are entitled to maternity leave if they live in the same household with the child.

According to German Law you have to demand maternity leave 7 weeks in advance in written form from your employer.

You also have to determine the time when to take maternity or paternity leave in your case .


If you are entitled to paternity leave, i.e live in the same household with the child your employer has to grant it.

Thank you Schiessl for you fast response. Let's try to clarify:
1) How to define "live in the same household"? After the baby is born, we'll live together with baby everyday. Before it, Some time we live together; Some time we have to live in different country since we work in different country.


 


2) How should my employer in Germany count my paternity / maternity leave, does it matter that my wife is employed in UK?

Living in the same household is defined as living together and of course it is not required that you live together everyday since many people have to work in different countries or different cities.


It should not matter that your wife lives in the UK because paternity or maternity leave is according to European guidelines and you are working here in Germany, so you get paternity leave according to German Law

Ok, that means, I can take another 6 months maternity leave from my wife's quota. A couple of more clarifications:


1) A few months of my wife's maternity leave is paid, others are no pay. For the leave I'll take from her, is it paid or no pay?


2) What shall I write in the notice to my company? according to ...... law? with ...... wsupporting doc?
