Good evening, Saturday I bought a car from a Händler. In internet was written as a vehicle has a "grune plaket", when I came to this Händler was stuck on the windscreen this "grune plakete", I checked the car documents and if the previous registration numbers coincide with the number writen on this "grune plakete" on windscreen. Seems to be all ok. On the way to home when I was driving this car appeared some technical problems appeared some technical problems with car. Yesterday I went to register the car in my name but in zulassungsstelle the women that work with paper from my car say that my car have not a "grune plakete" but a "gelbe plakete" and that on windscreen of car stand a false (falsch) "grune plakete". I want to know if I can return this car back because besides that the car has problems I need a car with "grune plakete" becouse I live in frankfurt. What should I do about it. I've already been to the police and complained that they sold me a car with a false (falsch) "grune plakete" and car has technical problems which they dont told me about. The Police called them and they said I could bring the car back but when we phoned they, said that they will not take back this car. What Can I do in thsi case?

Hi,

 

the mere fact that there is a false green badge on the car does not mean that it was an essential part of the contract that the car would be entitled to have a green badge.

 

However, even if not stated in the contract most courts will consider the green badge being explicitly mentioned in the internet advert.

 

If it is possible to upgrade the vehicle to a green badge state (which is in most yellow badge models is possible but may cost around 1000 Euros) you cannot give the car back at once.

 

You should declare the problem in written form to the vendor and ask him to solve the problem within 2 weeks (mention an actual date). The vendor should tell you when you can bring the car to fix it. The state that in case he would not do so until the deadline you will give the car back and recover the full paid price.

 

If then nothing happens (and you can proof reception of the letter) you can go before court. In that case you should contact a local lawyer.
