Claudia Schiessl :

Customer:

konnen sie English?

Claudia Schiessl :

Yes of course , I am fluent#

Customer:

oh this is good

Customer:

so i have to go to see an

Customer:

a lawer

Customer:

or i just have to go to Jungentarmt?

Claudia Schiessl :

Do you want me to explain what I have just written in English

Customer:

yes please

Claudia Schiessl :

According to the law you are entitled to child support until your child has finished his or her education and is able to earn his or her own money.

Claudia Schiessl :

The child support is according to the so- called Düsseldorfer Tabelle, which gives the child support according to the child`s age and the father´ s income.

Customer:

normally i want him to pay as much as possible because we were living together and when i was in 5 months he just moved to france because he said he earn more money...he is franch and works here in germany...and now that we were speaking to pay a taggesmutter he said that he doesnt want to pay more than 200Euro...

Customer:

is not any problem if he leaves in France or?

Customer:

and he is franch citizen...?

Claudia Schiessl :

Also you are entitled to support for yourself, which he has to pay until the child is three.

Customer:

so i will have any problem if he leaves in France and is franch citizen?

Claudia Schiessl :

It does not matter that he is a French citizen

Claudia Schiessl :

As long as you and the child live in Germany , you are entitled to support according to German Lawe.

Claudia Schiessl :

The Jugendamt helps with child support , yes but for your support you have to go to a lawyer.

Customer:

ok.so even for example he doesnt work here in germany and somehow disippear because he is football playes he will be

Customer:

he schould pay too

Claudia Schiessl :

Yes of course

Customer:

a last question ......do you think that i will have difficulties to get these rights????and how much do you think that would cost me a lawer?

Claudia Schiessl :

It depends on what he is doing and how much the support is going to be.

Customer:

what he is doing like what?

Claudia Schiessl :

If you do not have much money there is the possibility that the state pays for your lawyer.

Customer:

if i have money?

Claudia Schiessl :

Wheter he is just writing letters or filing a motion.

Customer:

so is good idea to go to a lawer

Claudia Schiessl :

Well, lawyers fees are strictly according to the law.

Claudia Schiessl :

Yes and it has to be a Fachanwalt für Familienrecht like myself.

Customer:

ok

Customer:

so how much do you think that would cost me...estimate.....

Claudia Schiessl :

Well if it is outside of court up to 1000 Euros.

Customer:

ok.Thank you very much!!!Now is not to late to go to a lawer if i have this child for 29 days or?

Claudia Schiessl :

Oh no, it is not too late.

Claudia Schiessl :

Just do not let yourself talk into joint custody.

Claudia Schiessl :

He has to acknowledge the paternity, though

Customer:

what does it mean?

Customer:

he says that he is the father but till now he didnt sign any paper

Customer:

like i think here you say vaterschaft

Claudia Schiessl :

He has to acknowledge paternity . Without that he is the biological father but not the legal father.

Claudia Schiessl :

Have you got any further questions ?

Claudia Schiessl :

Please be my guest

Customer:

i didnt really understand what do you mean with your last answer

Customer:

legal father is when he sign or?

Claudia Schiessl :

The acknowledgement of paternity is a formal act in which he declares to be the father with all legal consequences.

Customer:

and if he doesnt want to do this?

Claudia Schiessl :

Without the acknowledgement the child is not legally his and is not entitled to any supprt.

Claudia Schiessl :

If he does not want to you MUST go to court and sue him for it

Customer:

ok.thank you very much.i just dress and go to a lawer

Customer:

layer

Customer:

thanks thanks

Customer:

bye bye

Just do not let yourself talk into joint custody......

What do you mean?I have an appointment on Monday to a lawyer but maybe you could give me more information to have an idea about this...So if he lives in france and work here he should pay us...?and if he doesnt work here anymore...if i understood good it doesnt matter if he lives in another country

He has also another kid in france but i have no idea if he pays for this kid or not or if he was married...but i think it doesnt matter or?in this moment somehow i know nothing about him....Normally it doesnt matter how good is the lawyer or?I will have this support 100%???

Joint custody is that you can only decide together about things concerning the child.

If you are not on good terms with him this might not be such a good
idea

If the kid lives here he has to pay according to German Law no matter where he lives.

As he lives in France and not in some remote country there should not be any difficulty obtaining the child support from him

Kunde: hat geantwortet vor 4 Jahren.

the child has my name and we still have to put the name of the father on the geburtskunde.and normally he should sign the vaterschaft...this means that he is just the father but without any right on the child or?

Experte:  Claudia Schiessl hat geantwortet vor 4 Jahren.

Yes, paternity means just that

He has the right to visit the child, though
Kunde: hat geantwortet vor 4 Jahren.

and the joint custody normally when and were should be done. You know i dont really understand Deutsch and i dont want to sign any paper without knowing what is ...

or i just have to decide this when i go to the lawyer?well i decided to have just me the custody and for this reason im afraid to make any mistake....

do you think that i will have problems me to get also support from him?because i understood that the child will have 100% even if the father lives not in germany

Experte:  Claudia Schiessl hat geantwortet vor 4 Jahren.
Yes the child has to have 100 %.

If you do not sign anything you have sole custody

Do not worry
